Ex-migrant shelter employee found guilty of molesting unaccompanied minors

A federal jury has convicted a former Southwest Key employee of molesting multiple boys at a migrant shelter in Mesa.

Authorities say Levian Pacheco sexually abused unaccompanied minors ranging in age from 15 to 17 while they were being held at a Casa Kokopelli Southwest Key Facility over an 11-month period. 

Pacheco was found guilty Friday of seven counts of abusive sexual contact with a ward and three counts of sexual abuse of a ward.

In his role as a youth care worker, Pacheco, who is HIV positive, was responsible for supervising the minors held in detention while they waited to find out whether they would be deported.

A boy from Guatemala said Pacheco came into his bathroom and groped him as he washed his hands, according to court documents. Another said he was abused while in medical isolation three times. A third teenager said Pacheco tried to engage in anal sex with him.

The jury convicted him of abusing seven different boys — some of them multiple times.

Southwest Key spokesman Jeff Eller said in a statement that trial testimony proved the organization acted immediately after they learned of the assaults and placed Pacheco on suspension.

“We are grieved that abuse occurred in one of our shelters and, with the victims,
take comfort in justice having been served,” Ellis said. “As an organization, we believe in transparency.”

Sentencing was scheduled for Dec. 3.

Before Trump ‘zero tolerance’ policy 

The abuse occurred before the Trump administration enforced the controversial “zero tolerance” policy that ordered the separation of children from their families after they illegally crossed the U.S.-Mexico border.

Most of the children at the facility while Pacheco was employed were being held after they illegally entered the country by themselves. 

The Texas-based nonprofit houses more than 1,500 migrant children in Arizona, California and Texas under a $458 million contract with the federal Unaccompanied Alien Children Program.

Eight of those facilities are in Arizona.

Conditions at the shelters came under scrutiny earlier this year after the zero-tolerance policy began. 

An investigation by The Arizona Republic found multiple reports of sexual abuse and harassment at both the Glendale and Tucson locations. 

Pacheco’s was just the latest child-molestation conviction of a staff member at an Arizona migrant center.

Oscar Trujillo, a Tucson facility employee, was convicted of class 5 sexual abuse after he inappropriately touched a 15-year-old boy and tried to pull his pants down in 2015. 

Fernando Magaz Negrete, 32, was arrested in July on suspicion of molesting a 14-year-old girl while he was an employee of a Southwest Key facility in Phoenix. Court documents alleged he kissed the girl multiple times and touching her breasts and crotch over her clothes in the bedroom she shared with two other minors at the facility.

He pleaded not guilty to the charges in August.

SALT LAKE CITY – A woman convicted of helping a former street preacher kidnap Elizabeth Smart as a teenager from her Salt Lake City bedroom in 2002 and hold her captive will be released from prison next week.

The surprise move announced Tuesday comes after authorities determined they had miscalculated the time 72-year-old Wanda Barzee previously served in federal custody.

Barzee pleaded guilty to kidnapping Smart and helping keep her captive for nine months before Smart was found and rescued.

Utah Board of Pardons and Parole spokesman Greg Johnson said Barzee will be freed on Sept. 19. She will be under federal supervision for five years.

Smart, now 30, didn’t immediately have comment.

The board said previously that Barzee would be released in January 2024 after it denied her an early parole following a hearing that she chose not to attend.

Bobi Wine urges US to end military aid to Uganda

Robert Kyagulanyi, a Ugandan pop star-turned-opposition politician whose detention last month drew international attention, has called on the United States to stop supporting his country’s military.

In an exclusive sit-down interview with Al Jazeera, his first for television since receiving treatment at a hospital in the US, the 36-year-old, who also goes by the stage name Bobi Wine, said the Ugandan government uses US backing to stifle dissent at home.

Speaking to current affairs programme Talk to Al Jazeera, Kyagulanyi  urged the US Congress to suspend the $800m support for the Ugandan military, which he accuses of torturing him during his detention in August.

“It’s important, especially to the US taxpayers, to know that much of the military aid we get is actually used to oppress and brutalise the citizens of Uganda,” said Kyagulanyi.

“The gun that killed my driver that could have probably killed me is an American gun.”

The MP and vocal opponent of President Yoweri Museveni arrived in the US on September 1 to receive treatment after he was allegedly tortured by Ugandan security forces – a claim authorities denied but vowed to investigate.

Kyagulanyi had been arrested and charged with treason over his alleged role in the stoning of the presidential motorcade car during a by-election campaign in the northern town of Arua on August 13.  Later on the same day, Kyagulanyi wrote on Twitter: “Police has shot my driver dead thinking they’ve shot at me.”

The arrest of the self-styled “Ghetto President”, who was elected to parliament last year as an independent candidate, sparked protests and saw the deployment of the army and police on the streets.

Kyagulanyi told Al Jazeera’s Andy Gallacher he was afraid for his life but that would not stop him from returning home.

“I am fearful as a man but I don’t have another country. Uganda is my country. So, I either live in a dignified country or I will be remembered as a Ugandan who died trying to make a better Uganda,” he said.

Kyagulanyi represents a new challenge to Museveni, emerging as a powerful opposition voice among youths frustrated by Museveni’s 32-year rule, especially after a constitutional amendment last year that removed the presidential age limit of 75.

Museveni took power in 1986 and has since been elected five times.

Kyagulanyi said the opposition is united in their desire for change, in a country where the vast majority of people are under the age of 30.

“What unites us is not the identities of the political parties or sections that we belong to, but the desire of freedom and liberty that we have,” he said.

“Our desire as the oppressed people is to redeem ourselves,” added Kyagulanyi.

“We’ve always wanted to free Uganda but that free Uganda should not come at the cost of torture, should not come at the cost of murder or illegal executions … it should be got free because our generation feels like the price has already been paid.

“We are met with brutal force every time we try to raise our voices, every time we try to seek for the change that we know we constitutionally deserve.”

Apple is expected to introduce three new iPhones, and possibly new Apple Watches and iPads. The fun kicks off at 10 a.m. PT at Steve Jobs Theater in Cupertino, California.

On mobile, desktop, and laptop

Apple says its livestream is best experienced using Safari on iOS 10 or macOS Sierra 10.12 or later. You can head to Apple.com, where you’ll see a landing page with live video, or head directly to the September 2018 landing page

For Windows users, Apple says you should watch the livestream using Microsoft Edge on Windows 10. You can also watch on the latest versions of Chrome and Firefox.  

If you miss all of the action, you can watch an on-demand version of the event shortly after it ends on Apple.com.

On your TV

If you want to tune in on the big screen, you will need at least a second-generation Apple TV with the Apple Events app. Open the app and navigate to the September 2018 event.

Louis C.K. reportedly phoned Roseanne to commiserate after career implosion

Roseanne Barr and Louis C.K. might not be the best of friends, but they reportedly bonded over their careers imploding this year.

That’s according to actor-comedian Norm Macdonald, who told The Hollywood Reporter about a chat the two apparently had in the wake of Barr losing her ABC sitcom Roseanne last May.

“Roseanne was so broken up [after her show was canceled] that I got Louis to call her, even though Roseanne was very hard on Louis before that,” Macdonald said. “But she was just so broken and just crying constantly. There are very few people that have gone through what they have, losing everything in a day. Of course, people will go, ‘What about the victims?’ But you know what? The victims didn’t have to go through that … They both said they had a good conversation and were just giving any advice you could give to each other. There would be no way for me to even understand that advice, because who has ever gone through such a thing? All their work in their entire life being wiped out in a single day, a moment.”

Barr previously had criticized Louis C.K. in the wake of his sexual misconduct allegations, noting, “I’ve heard so many stories. Not just him, but a lot of [male comics]. And it’s just par for the course.”

Macdonald also claims the “#MeToo movement has slowed down” and says that’s a good thing.

“I’m happy the #MeToo movement has slowed down a little bit,” he said. “It used to be, ‘One hundred women can’t be lying.’ And then it became, ‘One woman can’t lie.’ And that became, ‘I believe all women.’ And then you’re like, ‘What?’ Like, that Chris Hardwick guy I really thought got the blunt end of the stick there.”

Hardwick was accused of sexual assault and emotional abuse by ex-girlfriend Chloe Dykstra back in June. AMC hired an outside agency to investigate the claim and he was re-instated in July as host of Talking Dead.

Macdonald is promoting his new Netflix talk show, Norm Macdonald Has a Show, which premieres Friday.

Two more polls find Trump’s approval rating below 40 percent even as economy surges

WASHINGTON – Two new polls show President Donald Trump’s job approval rating has fallen below 40 percent – including one that shows a majority believe he is unfit for the office – as the beleaguered president defends against reports of a White House in chaos, even as the American economy surges.

A CNN poll released Monday found Trump’s approval had dropped to 36 percent, down from 42 percent in August. And the same day, a poll from Quinnipiac University found Trump’s approval at 38 percent, down from 41 percent the month before. 

The Quinnipiac poll also found that 55 percent of Americans believe Trump is not fit to serve as president, while 41 percent said he is capable. Sixty-five percent said the president is not level-headed and 42 percent said he is not mentally stable. 

The Quinnipiac poll was conducted from Sept. 6 to 9, with a margin of error of plus or minus 3.7 percent. 

The CNN poll, which was also conducted from Sept. 6 to Sept. 9 with a margin of error of plus or minus 3.8 percent, found only 32 percent of respondents who believe Trump is “honest and trustworthy.” He got his highest marks for his handling of the economy at 49 percent, while 35-36 percent gave a thumbs up on his handling of immigration, foreign affairs and foreign trade. 

The weekly approval poll from Gallup found Trump’s approval slightly higher at 40 percent, while Rasmussen Reports, which consistently reports higher approval ratings for the president than other polling outfits, put him at 47 percent.

Last week, an ABC News-Washington Post poll found Trump’s approval rating was 36 percent, matching his previous low in their polling. It put his disapproval number at 60 percent, a new high. 

The Real Clear Politics average put his approval at 41 percent, its lowest point since March when Trump began to ramp up sanctions on imports into the U.S. 

With an expanding economy and low unemployment, the president has expressed frustration at the amount of negative news coverage swirling around his administration (including the ubiquitous attacks on “fake news”).

But a stream of reports describing White House disorder and infighting, from secret recordings by former adviser Omarosa Maginault Newman to the anonymous New York Times op-ed and Bob Woodward’s new book, have drowned out much of the positive economic data. 

For example, although the Quinnipiac poll results were negative for Trump, 70 percent of the respondents described the state of the economy as good or excellent. 

Republican support for the president remains strong. A majority (52 percent) of Republican respondents to Quinnipiac said they do not believe the allegations from the purported senior White House official in the Times op-ed.

His approval within his party was at 84 percent with Republicans in the Quinnipiac poll and at 82 percent in the one from CNN. 

“The economy booms, but President Donald Trump’s numbers are a bust. An anemic 38 percent approval rating is compounded by lows on honesty, strength and intelligence,” said Tim Malloy, assistant director of the Quinnipiac University Poll. “But Trump’s base remains loyal.”

‘Predator’s Olivia Munn tells Ellen, ‘I don’t want this career’ if it means staying quiet

After getting the cold shoulder from her “Predator” cast and crew for publicly revealing that director Shane Black had hired a registered sex offender to act opposite her in a scene, actress Olivia Munn got a warm embrace from Ellen DeGeneres.

In an interview set to air Tuesday, the talk show host told Munn, “Good for you for because I’m on your side. I think people should always speak up when they see something happening. I think being quiet when there’s something that needs to be addressed is the wrong move.”

Munn, 38, recounted how an acquaintance had told her after the fact that Black had cast longtime friend Steven Wilder Striegel, a convicted sex offender, to play a character who hits on her in the movie. 

“He was a 38-year-old man at the time and went after a 14-year-old female relative,” she told DeGeneres. (Striegel pleaded guilty in 2010 and served six months in prison, after which he was legally required to register as a sex offender.)

“When I found out, I did call Fox and I said, ‘We have to delete the scene.’ And they did, thankfully.”

While Munn didn’t know her source terribly well, she said, “I figured, in that moment, they weren’t calling to give me the heads-up. It was going to be something that would get out there. So I wanted to give my co-stars a heads-up so they wouldn’t be blindsided like I was.”

 

The day after she called her castmates, she got “chastised” for doing so by studio personnel, who wanted to know why she wasn’t “just keeping it quiet.” After all, they told her, “it got deleted. What’s the big deal?”

Munn explained why she wasn’t content to leave things there.

“When we do movies, we have this reach. It goes everywhere. There are people all over the world that see what we do,” she said. “And just that tiny drop of fame can be used to hurt an impressionable person. And that’s just not OK.” 

She added, “I had no idea how bad the details of the case were and what happened to that girl until it came out in the L.A. Times on Thursday.”

The Times story detailed how a March 2009 arrest warrant alleged that Striegel had molested the unidentified Connecticut teenager, “kissing, touching Jane Doe’s breast over her clothing, rubbing her legs and stroking her neck” – and did so on more than one occasion.  He also told her that he wanted to have sex with her in one email and described his sexual preferences in others. He also warned her not to tell anyone else about their correspondence, though her father found it and cut off contact.

In his response to the newspaper, Striegel stressed that he was charged for his words, not physical contact: “Nothing supported such a claim (of physical contact), and no charges in that regard were even filed. The only thing I was ever charged with were words in an email.”

Munn, who said she was threatened after accusing director Brett Ratner of sexual misconduct last year, said she believes the underlying problem is “the people who collude to keep people like this in positions of power – the people who keep turning blind eyes.”

As for her co-stars’ initial lack of support, Munn initially suspected it was because “they didn’t know what to say and wanted to stay out of the way. But privately, I did feel iced out. And I think what’s really important for people to understand is that when you see something, you have to say something. However, it’s not going to be easy. And there will be people who just get mad at you for not playing the game.”

She noted that co-star Sterling Brown did eventually tweet his support but added, “I think people expected me to be quiet because it was my movie. But the truth is, I don’t care if this movie gave me all the money in the world and all the power. If it cost one person’s life, they can take it. I don’t want this career.”

James Anderson took the final wicket to become the most successful fast bowler in Test cricket and secure a 118-run victory in the fifth Test against India at The Oval.

The 36-year-old bowled Mohammed Shami to claim his 564th wicket, surpassing the record of Australia’s Glenn McGrath.

It secured a 4-1 series victory for England, who were held up for much of the fifth day by centuries from KL Rahul and Rishabh Pant.

However, a stunning leg-break from Adil Rashid dismissed Rahul as the tourists fell from 325-5 to 345 all out.

England toil before magical finish

Anderson drew level with McGrath’s record with two quick wickets on Monday evening, but he and England could not force victory on Tuesday until late into the final session.

Rahul and Pant’s 204-run stand gave India faint hope of an improbable victory, but Rashid dismissed both players in successive overs to put England on top.

The final three wickets fell quickly: Ishant Sharma and Ravindra Jadeja both edged Sam Curran behind before Anderson bowled Shami with a full, straight delivery.

The players were then led off the field by Alastair Cook in his final Test match for England.

“The last two days will live long in the memory,” ex-England captain Michael Vaughan said on Test Match Special.

“What a week we have had and what a series it has been.”

Rashid produces ‘Shane Warne ball’

Although Anderson took the wicket that sealed the match, it was a superb delivery from Rashid that ended the frustrating sixth-wicket partnership between Pant and Rahul.

Rashid was overlooked for long periods in the morning and afternoon session, and when he did bowl, he struggled for control against India’s two attacking batsmen.

Pant, in particular, tried to dominate Rashid, hitting him for three sixes – one of which brought up his century.

With the new ball available after tea, the leg-spinner may have been expected to be taken out of the attack.

However, Root opted to persist with him – and the old ball – and he was rewarded when the Yorkshire leg-spinner produced a stunning delivery that turned extravagantly after pitching on leg to hit the top of Rahul’s off stump.

Former England batsman Geoffrey Boycott, speaking on Test Match Special, said the delivery was reminiscent of a Shane Warne ball.

The leg-spinner then dismissed the second centurion, with Pant hoicking the ball down to Moeen Ali at long-off.

Given India’s loose batting at times in this series, it may have been surprising to some that they were able to take the game into the final session.

But England let the game drift: Anderson and Broad both opened the bowling and were not seen again until the mid-afternoon.

Anderson’s reintroduction in the 68th over was greeted with the biggest cheer of the day, but he was faced with two set batsmen.

Broad’s omission from the attack may have been due to his broken rib, an after-effect of the blow he took when batting in the first innings, but Anderson’s absence, given his potency in this series, seemed strange.

Rahul & Pant frustrate England

That India got so close to England’s target was down to Rahul and Pant, who batted with intelligence and aggression throughout the day.

Moeen lacked penetration in the afternoon session while Rashid continually dropped short when eventually asked to bowl.

Pant in particular played some eye-catching strokes. He brought up his century in fitting style, getting down on one knee and launching Rashid over deep mid-wicket and into the stands.

Rahul too opted for the aerial route, smearing Stokes over extra cover for six before flat-batting the same bowler down the pitch for four to bring up his own ton.

The two also started quickly after tea, sharing a hug as they reached their 200-run stand, but they were unable to keep out Rashid as he found his line.

Despite the result, this has been a largely competitive series – and India have looked a much-improved side compared to the one that toured here four years ago.
